On the newest episode when Ben is in Charles' room, Charles asks Ben if he is there to kill him!.
Ben says something like, 'We both know I can't do that'

Ben can't kill Charles because thats not part of "the rules"!.
Instead he'll kill Penelope, because Charles changed "the rules"!.
In penance for Charles being responsible for the death of Alex, because of "the rules" being changed!.
Edit: Porsha, the reason Michael couldn't die is because the island had work for him!.

You cant die off the island, once you have been there! People think that Charles Widmore has been there before!.!.!.!.!.Thats the theory!. Remember the episode when Michael ( after he got off the island) kept trying to kill himself, and couldnt!? He sees Tom ( one of Bens people) and Tom tell Michael that the island wont let him die!.
