It was an accident. He was tring to get rid of the gun and dropped it, and it accidentally fired, hitting Kate. (Un)lucky shot, eh?

Michael did so, accidentally that is, he had removed the gun he purchased from thug kids and was handling it when he inadvertently caused the weapon to fire. The gun had already been loaded with the single bullet that Michael retained upon Mike, from the diner, forcing him to chuck the bullets into the water by the waterfront. Anyway, Michael intended to use the weapon as protection against the text message killer, so Kate was certainly not his intended target.
Michael was the one who shot Kate. He was monkeying around with a gun on the water front pier. He accidentally dropped the gun and the gun went off. And it shot Kate up near her heart.
Micheal shot her by accident. he was trying to get rid of it in a dumpster outside of a building and Kate was walking by and Micheal dropped the gun and it went off and shot her.

Technically, no one. MyKill dropped the gun and it fired. It was the writers' way of wimping out on what could have been a really interesting storyline -- instead we get junior on the run for no real reason beyond Sonny telling him not to come home (wonderful parenting, that).
