Ever notice on these cop shows , they make it look like lawyers can keep the suspect from getting arrested?
They always walk out of the interview room and say something like "My client and I are leaving." WHEN IN REALITY , my lawyer told me (when I was having some legal trouble) that he couldn't stop them from arresting me , if it came down to it.

That's because they have nothing to charge them with yet, It's just a questioning. If they had anything they would have been charged. Once you're charged a laywer can't say we're leaving.
