Since you're both married the ground of filing a lawsuit for sexual harassment won't hold in court. I suggest you go for "sexual intercourse incapacity (for he only kisses you) or lack of satisfaction/failure of giving full or ultimate pleasure". I assure you the Jury would immediately find him GUILTY.
