All horses and ponies need some sort of stable to retire to in the evening where they can sleep and be kept from the elements. If this is not provided then the owner is deemed as irresponsible. In view of this you need to report the situation to some authority that deals in animal welfare. A good start is to take a photo for your own evidence and report it to the RSPCA or other animal welfare group and see what their response is. I'm afraid you can't do any more than that, at least you can rest assured that you have taken steps to save the horses from further neglect.

Hmmmm....yea carrots are fine...Also...horses are pretty resilient...you know they live outdoors in Montana where its gets to be 40 below....so...

yes report the owner...the horses should have shelter and warmth and a proper regualr diet...horses cannot speak for themselves, so it's down to you to do it for them....if they look miserable, then they prolly are...do a good deed and get them horses saved....

offer to put them in your care for a while or report him, or just go open the gate and let them free...

yep

There must be a law that says they need proper shelter. If no offence has been commited then no action will be taken so report it and you have nothing to lose. Think about how you will feel if you let it continue without reporting it.

If you have any concerns then you should contact someone.
After all, what is the worst that can happen....they will be either given the all clear or found new, loving homes.

You should contact your local humane society or similar group who will listen to what you are saying. They are familiar with the laws governing quality of care for animals.People who have animals are expected to give animals at least a minimum standard of care and shelter.I would check it out, they will not reveal your identity to the owner so you will not be drawn into this. You will at least have the peace of mind that you may be saving these animals from possible neglect. From what I understand the Humane society tries to work with the owners and educate them on their responsibilities as an animal owner.Thank you for caring enough to get involved.
