Marylin Monroe, Copyrights: Incurably Romantic?!

Question: I would like to use the song "Incurably Romantic" performed by Yves Montand and Marylin Monroe on my website. Anybody knows who I should contact to hopefully obtain the authorization? It would be a ccial websit, but the track is for entertainment purpose only while visiting the website. No download possible.

According to an ASCAP search, the song Incurably Romantic was written by Sammy Cahn and Jimmy van Heusen, and first performed by Bing Crosby.

The publisher and administrator of rights is listed as

EMI MILLER CATALOG, INC.
c/o EMI APRIL MUSIC INC.
c/o EMI MUSIC PUBLISHING
75 Ninth Avenue, 4th Floor
New York, NY 10011

The telephone number listed is: (212) 492-1200

Given the constantly shifting legal interpretation of "fair use" as applied to the internet, you would really be best served by requesting permission of the publisher/administrator.

The fact that you are using the music for a non-commercial purpose does not, in and of itself, qualify your use of the song as "fair use". The law is a mess in this area - do yourself a favor and call EMI - it's probably a question that they get all the time.

Good luck!

I'm not sure. But I LOOOOOVE Marilyn Monroe. She is my icon !! SOOO BEAUTIFUL !!!

If you can find it on imeem and load into your player, then embed it on your page; that is legitimate.
