Yes, he will still be used in Batman. The movie is done with the filming, it's in post-production now. Even if he died midway through filming, they would just replace him with someone else (that's what they did with the movie The Crow when Jason Lee died).
I think that with his death, even though it sucks, the movie will do well. It's still going to be advertised as having Heath Ledger starring in it. I think his death will just spark all of his fans to see his final movie.

Nothing is impossible in Hollywood! They used a computer image of Brandon Lee to finish the making of The Crow. They could possibly use a computer image of Ledger to finish the making of the new Batman Movie.?
dark knight is in the post production stage. meaning, it has been filmed before heath ledger died and they are just doing the finishing touches of the movie. so he is still very much part of the movie as joker. he just can no longer promote it since he is no longer around to do that. thats the sad part.
