He was one of the guys chasing Bourne (Treadstone). Bourne got between the cops and the guys chasing him. The Treadstone guy shoots misses Bourne and it's like he is shooting at the cops.
it also the one who is going to kill bourne but he misses and killed the cop who stopped him
