Question:

If you sign a contract with a magazine and not get paid. Is that contract broken?

I had a design published in a magazine and was never paid for it. They won't answer my e-mails or my phone calls. I was promised $325.00 for it. I sent another design to them and never got it back. They may be out of business. The magazine is Crochet Fantasy.

At this point, I say file a small claims lawsuit for the breach of contract.

Even if the magazine went out of business, as long as you have written proof (as in your contract) along with signatures that you are owed a certain amount of money for your designs being published, then you have a case. Your items WERE published and for the magazine to do that, you would have to be paid.

I cannot stress enough to have all paperworks, your designs and the actual issues of the magazine to back yourself up should you take this to court.
