Is it illegal if I start an anime site with Fan-Subbed anime?!
Question: Is it illegal if I start an anime site with Fan-Subbed anime!?
I live in the USA!.
I want to start an anime site with the original Japanese anime but with English subtitles that fan-sub services have subbed!. I was wondering if this is legal since there is a lot of other sites that do the same the same thing!.
I will uploading the anime to a 3rd party server:

I will have anime on my own server too, but that would only be accessible for premium members!. They have to DONATE $5 to help with server cost in order to become a Premium Member!. A benefit for donating is having access to our Premium Downloads hosted on our server!.
Would anyone really even consider taking actions against me!? Would it really become a big issue to the point where I have to close down the site!? How do those other sites get away with it!?Www@Enter-QA@Com

if you want to host it on your site the first thing is found who fan sub the anime
second, you need to get permission from the fan subbers to allow you to host it,
usually you just have to follow the rules, give them credit,
just contact them by going to there sites or check there rules to see if they allow people to host there work
sometimes they say what you should do for you to host it

Anime is copyrighted in Japan, and under the Berne Convention, which protects international copyright laws (http://en!.wikipedia!.org/wiki/Berne_conve!.!.!. ), those copyrights are protected in the United States as well!. Thus hosting and uploading this anime would be illegal (even if you are just hosting links and uploading to a 3rd party)!.

==> Most likely no!. ESPECIALLY if you aren't hosting any anime that is licensed in America!. If you are hosting soley unlicensed anime, then there isn't really anyone in the US who would have an interest in taking you down!. also, even if you had licensed anime, a company would usually send you a Cease and Desist order instead of actually charging you or closing you down!. However, there are ALWAYS exceptions and since it is illegal, the possiblity always exhists of you getting in some form of trouble!.
also note that since you are hosting on Megaupload, you really don't have much control over the content!. Stuff get's taken down from there all the time!. All it takes is one person to report a link as being copyright infringement, and the file will get removed (this is the thing that is most likely to happen to you)!.

I don not know if this is illegal in the US, but the cite www!.tvlinks!.co!.uk in UK was shut down by FACT!. What it did was simply to provide a place there it was possible to place a link to the anime or TV series!. This web page was totally free for users!. The owner was arrested but later released!. He was just cautioned!. There is no case in question because the owner just gave up!. The main reason here was that the cite was too popular for comfort of FACT and felt a victim of its popularity!. (It was always mentioned here as a place there to watch an anime)
So, anyway about your site!. If you wanna do a community service it is a good idea, as a business venture this project is very doubtful!. The competition is so intense!. No one will pay even $5 for membership, your best bet for profit will be advertising!. However, that is not to say that there is no successes!.
