well, that is unknown at the moment. All we know about Tobi is that he is an Uchiha member. There are two possibilities of Tobi's identity. One is that he is Madara Uchiha since Itachi Uchiha and Pain state that Madara is alive and part of the Akatsuki. The second possibility is Tobi is a subordinate of Madara Uchiha (highly doubt it though since he knows space/time ninjutsu. But he could be using the same technique Kisame and Itachi used to confront Team Kakashi and Team Gai during Rescue Gaara Arc). All we know for sure is he's an Uchiha and related or is Madara Uchiha.

no toby isnt obito uchiha. Obito died, its the only way kakashi would have gotten the mangekyo sharingan. Hes most likely Madara Uchiha.
