He is still around. Well at that part after he was fighting Kakashi he had use and ANBU disguise to trick Kakashi,and escape through the window. Afterwords,he rejoined with Orochimaru.

He escaped. Hes with Orichimaru and Sasuke.
He concealed himself as an ANBU. Then after the fight with Kakashi-sensei, he rejoined with Orochimaru.

he was on the floor in one of the anbus clothes and used a body manipulation jutsu and transformation jutsu to disguise the dead body while he used it like a puppet then when kakashi was distracted he went out the window.
