His name is Yamato. He is a temporary replacement from ANBU, who was a test subject of Orchimaru in the past. He put the DNA of the 1st in 60 subjects, all died except for Yamato who is the only one besides the 1st that could do the 'Tree' Mokutan jutsu. This is important because with this jutsu the Kyuubi (Naruto) can be contained.
