Before I saw the movie (and I saw it the day it came out), every person who said that sounded like they were saying that just because he was dead!.
But Heath shaped one of the creepiest characters that I have ever encountered in any form of entertainment (and I encounter a lot - I am a James Patterson/Law&Order buff)
I think that even if Heath were alive he would get nominated!. He gave his life to the part of The Joker and demonstrated his immense acting skills!.
If only he were alive to make a sequel!.

yeah i agree totally!. even if he isnt still alive (God Rest His Soul, still love ya man) his performance as the Dark Night was awesome!. not to mention some of his other roles in other movies like the A Knights Tale!.
