Those ages do constitute statutory rape in almost every state and contrary to what the 1st answer said the parents dont have to press charges in order for him to be arrested. The state can choose to press charges all by themselves. The dont need the consent of the parents. They can do this becuase many parents are neglective of thier kids and their welfare and the state must step in to protect the kids.

The problem you run into is jurisdiction. If Jamie Spears wont cooperate with the police and the parents wont. It would be hard for a Department to prove that the crime took place in their jurisdiction. Although they have proof that the crime did take place it must be prosecuted in the jurisdiction it happened in and without proof it did they can not charge him

When I worked for the Sheriff's Department we arrested many boys that were over the age of consent for having sex with minors without the girl's parents consent. In fact many of the parents of the girl testified for the defense at the trial.

Just becuase you are a parent doenst allow you to approve of things that are illegal.

And to think the mother is writting a book on how to raise children. HA HA

You can see by the map on the link that only 12 states have an age of consent of 16 years old. With that being said even in the states where the age of consent is 16 it doesnt mean that statutory rape can not happen at that age it just means that that is the youngest age that a person can consent to sex. meaning it could only apply to people of like ages and still could be illegal if one of the parties is over a certian age like 18 or 19. Meaning a 16 year old can consent to sex with a 17 year old or younger but not someone of the age of majority (18 or above)

ADDITION: Will he see the inside of a jail. Chances are 99.999% that he wont. Why? 1st becuase they are famous and celebs are not treated the same. 2nd becuase of difficualty in proving where and when the offense happened. Due to legal loopholes and the state having to prove things exactly he would get out of it and the state knows it and wont persue a case they know they can't win. It throws off their % of guilty verdicts.

Maybe the parents should be charged with neglect for their over all care of both of their children and they could share a cell with lindsay lohan's mom.

Unless the parents press charges, nothing will happen to him. Oh, he'll probably write a book and sell his story to OK magazine and star in a Lifetime Network for Women Made for Television movie, but other than that, he'll never see the inside of a pokey.

He probably won't get in any trouble. Celebrities seem to get away with murder. It was consensual, she was living with him, so I don't think he will get in any trouble.

I doubt it as its been widely reported that he was living with Jamie Lynn at her home with her moms approval.

No not unless Jamie's parent decide to press charges. She wasn't forced so most likely they won't.
