Are the Rubinoos suing Avril Lavigne, or are they suing her songwriters; & W!


Question:

Are the Rubinoos suing Avril Lavigne, or are they suing her songwriters; & Will it affect her credibility?

Just wanting to know everybody's opinion on this legal fiasco: who are the Rubinoos actually suing?

Will Avril's credibility as an "artist" ( if you could call her that) be compromised, and if so, how severely will it affect her reputation among fans and her peers?

Another thing...I listened to both songs...the only remotely similar thing b/w the two is a few words in the chorus: "hey hey you you I can be your boyfriend" (or in Avril's case, the word "girlfriend"), other than that, Avril's song has a different melody and different lyrics. The Rubinoo's chorus uses harmonies, while Avril's chorus uses a "cheerleading" chant (which is more reminiscent of the '80s hit "Mickey").

Can she really be sued for one nearly identical line? If anyone is familiar w/ this type of lawsuit, please clarify.

I'm sorry, but I listened to the choruses, back and forth, over and over, and (IMHO) I think they are nearly identical. The cheerleader clapping actually does have a similar sound to the Rubinoos' song. The meter and rhythm are nearly identical, too. I tried to keep an open mind when I listened to the songs- I'd never heard either one- and I think that there are enough similarities to make this a legitimate cause of action. How it plays out- who knows?
